Vozelle Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Vozelle, an AI-powered voice transformation application and related services (collectively, the “Services”) provided by Gbyte.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

Eligibility

You may use the Services only if you are legally permitted to do so under applicable laws.

If you are under the age of majority in your jurisdiction, you may use the Services only with the consent and supervision of a parent or legal guardian where required by applicable law.

By using the Services, you represent that you have the legal capacity to enter into these Terms or that your use is authorized by your parent or legal guardian where required.

Description of Services

Vozelle is an Android application that provides AI-powered voice transformation features.

Depending on the features you use, Vozelle may allow you to:

• record audio;
• transform your voice using AI technology;
• save audio recordings locally on your device; and
• use transformed audio with supported third-party applications.

The features, supported devices, operating systems, voice models, and third-party application compatibility may change from time to time.

Accounts and Access

Vozelle does not currently require a traditional username-and-password account for general use of the application.

Certain features or subscription-related functions may require you to provide an email address or complete a verification process. You are responsible for providing accurate information and for keeping any verification codes or access information secure.

Your access to subscription benefits may also depend on your Google Play account and the applicable subscription status.

Subscriptions, Fees, and Payment

Certain features of the Services may require a paid subscription.

Vozelle may offer subscription plans on a weekly, monthly, or yearly basis. Subscription prices, plan availability, and features may vary by platform, region, or offer.

Subscriptions purchased through Google Play are billed and managed through Google Play and are subject to the applicable Google Play terms and policies.

Vozelle does not directly collect or store full payment card or bank account information when payment is processed through a third-party payment platform.

Subscription cancellation, renewal, refunds, and related billing matters are subject to the applicable platform's policies and the terms presented to you at the time of purchase.

Your Content and Voice Data

You may create, record, upload, or otherwise provide audio, voice recordings, and other content through the Services (“User Content”).

You retain ownership of your User Content. You are responsible for ensuring that you have all rights, permissions, and consents necessary to record, use, transform, or otherwise provide User Content through the Services.

In particular, if your User Content includes another person's voice, you are responsible for obtaining any consent or authorization required by applicable law.

To provide, maintain, secure, and support the Services, you grant Gbyte a limited, non-exclusive, worldwide, royalty-free license to process, store, transmit, and otherwise use your User Content only as reasonably necessary for those purposes and as described in our Privacy Policy.

This license does not transfer ownership of your User Content to Gbyte.

Acceptable Use

You agree not to use the Services to:

• impersonate another person or falsely represent another person's identity without appropriate authorization;
• commit fraud, deception, harassment, abuse, or other unlawful activities;
• create or distribute non-consensual intimate or sexually explicit audio involving another person;
• create or use voice content involving minors in an unlawful or exploitative manner;
• infringe or violate the rights of others, including intellectual property, privacy, publicity, or other legal rights;
• distribute malware, viruses, or other harmful code through the Services;
• reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying technology of the Services, except to the extent such restriction is prohibited by applicable law;
• use automated systems, bots, scraping tools, or similar methods to access or interfere with the Services without our authorization; or
• resell, sublicense, distribute, or commercially exploit the Services except as expressly permitted by us.

We may take appropriate action, including restricting or terminating access, if we reasonably believe that your use violates these Terms or applicable law.

Intellectual Property

The Services, including their software, design, interfaces, trademarks, logos, voice models, and other materials provided by Gbyte or its licensors, are owned by or licensed to Gbyte and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, license, or otherwise exploit any part of the Services.

Subject to these Terms, Gbyte grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purposes.

Third-Party Services

The Services may work with or interact with third-party applications and services, including WhatsApp, Facebook Messenger, Telegram, Instagram, Snapchat, and Discord.

Your use of those third-party services is governed by their respective terms, privacy policies, and other applicable rules.

Gbyte does not control and is not responsible for the availability, functionality, content, policies, or practices of third-party services.

Service Availability, Maintenance, and Support

The Services may be temporarily unavailable or interrupted due to maintenance, updates, technical issues, network conditions, device or operating system limitations, or third-party service dependencies.

We may modify, suspend, or temporarily limit certain features when reasonably necessary to maintain, improve, secure, or update the Services.

We may provide technical support and respond to user feedback at our discretion, but we do not guarantee that every issue will be resolved or that support will be continuously available.

Disclaimers

The Services are provided on an “as is” and “as available” basis to the extent permitted by applicable law.

We do not guarantee that the Services will always be uninterrupted, secure, error-free, or available at all times.

AI-generated or transformed voice output may vary depending on the input, voice model, device, operating environment, and other factors. We do not guarantee that voice output will meet your expectations regarding accuracy, quality, naturalness, or suitability for a particular purpose.

You are responsible for determining whether and how to use any transformed audio.

Limitation of Liability

To the maximum extent permitted by applicable law, Gbyte and its affiliates, officers, employees, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of the Services.

To the maximum extent permitted by applicable law, Gbyte's total liability arising out of or relating to the Services or these Terms will not exceed the amount you paid to Gbyte for the Services giving rise to the claim during the applicable period preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Gbyte and its affiliates, officers, employees, licensors, and service providers from claims, liabilities, damages, losses, and expenses arising from:

• your violation of these Terms;
• your misuse of the Services; or
• your User Content or violation of another person's rights.

Suspension and Termination

You may stop using the Services at any time.

We may suspend or terminate your access to the Services, in whole or in part, if we reasonably believe that you have violated these Terms, applicable law, or otherwise used the Services in a manner that may harm the Services, other users, or third parties.

Upon termination, provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, User Content, disclaimers, limitation of liability, indemnification, and dispute resolution.

Changes to the Services and These Terms

We may modify, update, suspend, or discontinue all or part of the Services from time to time.

We may also update these Terms when reasonably necessary, including to reflect changes to the Services, applicable laws, or our business practices.

When required by applicable law, we will provide notice of material changes through appropriate means. Your continued use of the Services after the updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

Miscellaneous

These Terms, together with any additional terms presented to you for specific Services or purchases and our Privacy Policy, constitute the agreement governing your use of the Services.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by applicable law.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent, except where such restriction is prohibited by applicable law.

These Terms do not create any partnership, agency, employment, or joint venture relationship between you and Gbyte.

Governing Law and Dispute Resolution

These Terms of Use and any separate agreements under which we provide the Services shall be governed by and construed in accordance with applicable law.

Any disputes arising out of or relating to these Terms or the Services shall be subject to the jurisdiction and dispute resolution procedures determined in accordance with applicable law.
